Thomas Arnold, sworn, deposed—On the 10th August last the cutter Dee, the property -of the defendant, was : blown against the Albert street wharf, and damaged it.. It was ' damaged by. defendant's cutter, and the repairs cost £5 odd. : '. ■ ' His Worship said the plaintiff's solicitor had not, so far, proved the case. He would have to prove there had been'negligence or that the accident oould hare been avoided. Thomas \ Arnold, re-called, deposed— The chain of the boat was a bad one, and it broke, and in consequence the vessel, drifted; against the . wharf.
