In the following cases judgment was given for plaintiffs with costs :—W. Wilson and Co. v. Kitchie—Claim, £22 14s,_ goods, and costs £3 17s. Macdonald and Miller.t. Bruce—Claim, £5 Is 4d, professiohalservices, and costs 14s. W. D. Head v. Dower—Claim, £8 Is 2d, goods, and costs 245. H. Mcllhone v. Raihi— Claim, £15, promissory note, and costs £218s". Thomas Arnold, sworn, deposed—On the 10th August last the cutter Dee, the property -of the defendant, was : blown against the Albert street wharf, and damaged it.. The defendant, could hare removed the boat. " • •'•'"''' F. C. Dean, sworn, deposed-r-I am Secretary to the Thames Harbor Board. I .know, the Albert. street, wharf It is the property,,.of, the Board. It was ' damaged by. defendant's cutter, and the repairs cost £5 odd. : '. ■ ' His Worship said the plaintiff's solicitor had not, so far, proved the case. He would have to prove there had been'negligence or that the accident oould hare been avoided. Thomas \ Arnold, re-called, deposed— The chain of the boat was a bad one, and it broke, and in consequence the vessel, drifted; against the . wharf. If proper precautions had been taken the damage! would not have been done; '■ > \, ■ ' Judgment for plaintiff, £5, and -costs £2 11s. Court adjourned.
