Mr Brassey, for the plaintiff, agreed to take a nonsr't ?i this case, which had been adjourned from last Court-day. Plr "itiff nonsuited ; costs, £6 12s. Beserved Judgment, casey y. hughes. Claim, £7 17s, goods. A set-off had been filed for goods the defendant alleged had been supplied to men in plaintiff's employ, on plaintiff's verbal undertaking to pay, and the ease was adjourned last Court day to deoide . the admissabiUly of the set-off. His WorsHp said, as a good deal of misapprehension existed amongst tradesmen about this end similar cases, he had reserved judgment. He had consulted Addison, Chitty, and Bussell, three authorities" on the subject, and was quite sure that the set-off came under the S atuteof Frauds, and he coi»!d not admit so that jufgment would go for the plaintiff, £7 16s 6d, with costs, £3 7s. Couij adjouvaed. -
