(Before W. Fraser, Esq., Warden.) GOLDSMITH V. GOLDEN ABBOW.

In the two cases of Goldsmith v. Golden Arrow for neglecting to use and pay rent on the two machine sites (Nob. 7 and 11), situated m the Tairua district,' on which His Worship reserved judgment last Court day, His Worship said that as there seemed to be some misunderstanding as to the case having been ad' journed till to-day, he would further adjourn it till Wednesday next. In the mean time he recommended the parties interested to come to some understanding about these machine sites.

CHESTBB V. BICB AHD THOM.

The plaint set forth that the defendants Walter Bice and John Thorn, being the registered owners of the Just-in-Time, situate at Waiotahi creek, have, failed to bona fide and continuously work the same from day to day by the number of men prescribed by the regulations, to wit, by one man for every 15,000 square feet of land comprised in the claim; wherefore the complainant claims that the defendants be adjudged to have forfeited their title to the said claim, and that the complainant may have the authority of the Warden to take possession of the said claim. There was no appearance of defendants. W. J. Chester, sworn, deposed—l am a miner, and hold miner's right No. 2765.

The defendants are two of the registered owners of the Just in Time claim, four of us having been the shareholders. I know tbo claim in question. It has not been worl.cd sinco January last, and I wish to get an order to take possession. Henry Clinker, sworn, deposed—l am a miner and know the Just in Time, Waiotahi. It has not been worked since January. „ F. Burgess, sworn, deposed — I am clerk to Mining Itegistrar and produce register of the Just in Time claim, four men's ground. Two shares have been abandoned. His Worship said he would make an order that the claim be forfeited, and that Chester he put in posscsion, with costs as against Thorn for £2 13s.
