Mr. Dodd appeared for the plaintiff. Defendant pleaded not guilty. All witnesses were ordered out of Court. . The plaintiff, Samuel Grainger, sworn, said—l am a settler at Te Poka. 0n the 15th instant I saw the defendant. He .assaulted me on that day. He accused a | 'servant of mine of stealing a pig. IHe was talking English. He called my servant, a thief. I went to see what was the matter when the accused charged me with stealing it. He then pushed me about and pulled my whiskers. He repeated this. I was on my own grounds ' .1 told him the pig was safe, so far as I knew. , f . . , - ■ William Robinson deposed—l saw Mr. Grainger and defendant on the 15th. There was a dispute, about a pig. Accused sung out to me, and said we had stolen the pig and called me a b thief. I saw ike defendant push Grainger and pull his beard-., There was no provocation given* Defendant said he went to Mr. Grainger about a pig. He spoke to him quietly. Mr. Grainger and he had always been good friends. The cattle and pigs of both parties ran on each other's ground. Kuka, s^rorn, said—That defendant asked plaintiff about a pig, and Grainger answered him angrily. Did not see him push Mr. Grainger. Eaima (a native woman\ sworn, said— She saw no anger shewn. She heard Hone ask Grainger if he had seen his pig. There was no pushing. His Worship said the evidence was so conflicting that he would dismiss the case without costs.- ' Court adjourned.
