Sydney, Nov. 3. In the Australian Banking Company conspiracy cases Mr Justice Windeyer summed up against the prisoners Francis Abigail (managing director), and Roderick McNamara (late manager). The jury acquitted Messrs Sal von and Twist, the accountants of the company, but found Abigail and McNamara guilty. Abigail protested his innocence, and declared that he was not conscious that he had done anything to defraud any man. McNamara also declared his innocence. His Honour, who apparently was much afiected, said that he had no doubt the conclusion arrived at by the jury was correct, and he regretted that lie could not think that Abigail’s fraud was a momentary lapse. It had been continued over a number of years, though he (the learned Judge) admitted that the prisoner had been the dupe of more wicked men. Abigail was sentenced to five years’, and McNamara to seven years’ penal servitude. Farther charges against the prisoners have yet to be heard.
