RESIDENT MAGISTRATE’S COURT.
Tesiuka—Tuesday, May 24, 1892. [Before Mr .1. M. Twomey, J.P.] drunkenness. Janies O’Brien was brought up charged with haying been drunk and disorderly on the previous evening. He pleaded guilty, and was dismissed. Wednesday, May" 25. [Before Messrs J. T. M. Hayhurst and J. M. Twomey, J.F’s.] LARCENY. John Brien was brought up, on remand, charged with having on the evening of Friday, May 20, stolen from the shop of James Patrick, Winchester, 10 sticks of tobacco and 21b of candles, of the value of iis. , The prisoner pleaded that he knew nothing at all about it. 1 ,( aiues Moore, sworn, stated that on the j evening meqtioqe4 in ihe information he ' was in company with William Colbert, in Winchester, and saw the prisoner enter Mr Patrick’s shop. He first took up some packages of candies and let one of them drop. He then went and took the tobacco and went out. Told Mrs Patrick and Mr Mclntosh. Baw Mr Mclqtpsh take him into the shop. ' Saw twb packages of 'lies found whore the prisoner was 1 not see the tobacco found, standing. l>iv, . ■ in the evening. It was about seven o’cloon.— William Colbert gave corroborant evidence. Did not see him take the tobacco. Saw him move his arms aud something fell. He then knocked, and aud when no one came he went behind the counter where the tobacco was kept. Saw him come out. Then parted company with Moore and went to Mr Carston’s shop. J. Mclntosh: Heard some one crying out that some one was robbing Mr Patrick’s shop. Went over and noticed something like a shadow near the wall. Found prisoner there. The 21b of candles aud the tobacco were found near where lie was standing. Brinkman found the tobacco. He was not drunk. J. Patrick : Was at Carston’s at the time he heard some one had been robbing his shop. Weut down and found the prisoner in the shop with some persons with him. Ho got very rowdy when the tobacco and candles were found, and witness tied him and brought him to the police at Temuka. Constable Bonrke, said that at eight o’clock on the evening mentioned in the information Mr Patrick brought the prisoner to him and he locked him up. Ho was sober. Next morning ho was very penitent, and said he was accused of many things wrongfully. He admitted he stole the tobacco, but denied that ho stole the bag of money for wl;icl; ho was convicted in Timaru. John Breen the prisoner, who gave | evidence stated that he did not remember »
anything about it. He was drunk and went into the shop and did not know what occurred. To Constable Bourke: Did, not remember refusing to pay for a drink at Mclntosh’s hotel. Was only one month out of gaol but he had been convicted innocently. The bench considered the case proved, and sentenced the prisoner to three months’ imprisonment with hard labor.
