ALLEGED SMUGGLING. Alex. White, the owner, and J. W. Alleston, the master, of the barque Ganymede, were charged at Timpru on Friday last with three breaches of the Customs laws Consolidation Act 1882 —(1) By illegally importing dutiable goods, to wit 401 bof tobacco ; (2) Making a false return to the customs, by omitting mention of the said tobacco ; (3) Wilfully breaking the customs seals on the doors of a cabin, in August last. Mr White for the customs department. Mr Hay for defendants, i C. F. Collins,juinor customs officer: Went on board at 2 p.m. 17th August, to seal up the stores and have a look, ' round. Asked Captain Alleston for a list of the stores and was told verbally what there was. Was shown 4 or 51b of tobacco in a locker and about 300 cigars; was told that was all there was, and he sealed them up. Searched the lazarette, and found a 401 b box of tobacco inside another case, with a bag thrown over the top. While there, heard White call out to Alleston to ‘‘ bring him up out of that at once. ” Went up and in the cabin asked Alleston what the tobacco was doing there. Alleston said he knew no hing about it, and he (witness) thougu. White made the same reply. Went down the lazarette again and made further search and then sealed it up. Searched the cabins, but found White’s cabin locked when he came to it, and as White had gone ashore he could not get in. Made arrangments to get the key but did not succeed; therefore sealed up the two doors, in the presence of the ship’s boy. Went on board with Mr Rich next morning and found both seals broken. The defence was the tobacco was for the crew; that White went on board in the dark and did not notice that his cabin door was sealed, hence the breaking of the seal. The case lasted all day, and the magistrate reserved his decision.
