RESIDENT MAGISTRATE'S COURT.

Temuka—Monday, Dec. 8, 1890. [Before C. A. Wray, Esq., R.M.] INEBBIATE. James Marshall, charged with being drunk in the public street on Dec. 6tb, admitted the offence. He was further charged with throwing stones upon a certain house to the alarm of the inhabitants. E. H. Brewer, saddler, Temuka, said that about fire o'clock on Saturday, December 6th, he was at tea. Heard a rattling sound like plaster falling. Went to the front premises, and saw Marshall in the street shoyelling shingle, some of which had fallen on the footpath and some in the shop, Marshall seemed excited. Did not speak to him. Did not think he was throwing stones maliciously. Mrs Brewer was upset about it. He was chucking them oyer his head and all ways. Defendant was further charged with damaging the property of the Temuka Town Board. G. J. Mason, a commissioner of the lemuka Town Board, saw Marshall clearing a track through the shingle in front of his premises. Asked him what he was doing. He replied that he was making a track across to the hotel as the stones hurt his feet. Damage to the amount of about 2s was done. The surfaceman had to replace the shingle. It probably took him about a quarter of an hour to do so. Marshall was the worse for liquor. Defendant said that the loose shingle had always been an eyesore to him, and he had often intended whea sober to clear it away. When he was in liquor the power to do it came to him. He now regretted the offence. Eined 20s for drunkenness, and cautioned on the other charges. CIYIIf CASES. C. Storey v. W. Bryant Claim 13s 6d, balance ot account.—Judgment for amount claimed, with costs: Clulee v. Latimore—Claim £l3 ss. Adjourned from last sitting of the Coucfc.—The clerk stated that nothing more had been done in this case, and and judgment was now given for the full amount claimed, with costs. A. Colville r. Geo. Stumbles— Claim £l6 3s. —Mr Salmond for plaintiff and Mr Hay for defendant.— Adjourned by consent for a week. The Court ther rose.
