Timaru—Tuesday, August 5.

(Before His Honour Judge Ward.) IN BANKRUPTCY

In re Henry D. S, Homes. Mr White applied for order of discharge. The Deputy Assignee reported that a preferential claim for wages was still unpaid. The bankrupt put this one down as a creditor for £B, and the creditor proved for £7 3a 4d for “ wages/’ Bankrupt was called to show this creditor was a partner not an employer, they took out £1 a week each, and were to take more if the business (bone crashing) paid. His Honour said it was an unsatisfactory' case, debts having been run ap to £3OO on a small value of assets. Discharge suspended for one month. Orders of discharge were granted to W. Warne, carpenter, Pleasant Point, and J. D. Anderson, merchant, Timaru, on the application of Mr White. In re D. Denoon, Geraldine, Mr Raymond applied on behalf of R. H. Pearpoint and others for leave to prove claims against the estate of the bankrupt. The Deputy Assignee and Mr Raymond showed that so far as known no creditor had proved in the estate, they deemed it a worthless proceeding, and in March of last year the bankrupt was granted his discharge, conditionally on his paying the Assignee’s costs. These costs had never been paid, consequently the discharge had not been issued. Recently the bankrupt had come into some property, at Home, and the present application was to enable the creditors to take advantage of it. The Deputy Assignee made mo objection, but pointed out that all ought to start fair. Leave given to all creditors to prove as if the bankruptcy commenced de novo. Applications for costs of debtor’s solicitor in J. Anderson’s case, and for Assignee’s costs in Drummond and Glasson’s estate, were granted. PROBATE. Probate of the wills of the late C. E. Cooper and R. Turnbull was granted to the relict in each case.
