[Before Captain C. A. Wraj, R.M., and Eev. G. Barclay, J.F.] CIVIL CASES.

J. C. Martin v. H. Hunter BrownClaim £55 7s Bd, for grubbing gorsa and cutting fences. Defendant was a tenant of plaintiff’s and had omitted to do the work in accordance with the lease.

Mr J. Hay for plaintiff, Mr F. Wilson Smith for defendant.

The case virtually turned upon the meaning of a clause in the lease regarding the clearing of the gorse. Mr E. P. Sealy, sworn, gave minute details as to the various places where the gorse needed grubbing and the fences cutting, pointing out the places on a plan. Also stated the estimated cost of the work at each place. Witness had had a considerable experience as a farmer, and had paid large amounts of money for similar work to that for which he was claiming. Had called for tenders for the work in three blocks. The three highest tenders amounted in all to £ll6 2s, and the three lowest to £59 Bs. In one instance had not accepted the lowest tender, as he was sure the contractor could not do the work for the price, Counsel for both sides having addressed the court, judgment was given for the amount claimed and costs, with two witnesses expenses, £2. M. Taggart v. Sugrue—Claim £2 15s, value of a bridle and breastplate lent. Mr F. Wilson Smith for plaintiff. Judgment by default for the amount claimed and costs. The court then adjourned.
