Geraldine—Thursday, Got. 13, 1887. [Before H. W. Moore and A. H. Brisco, Bsqs., J.P.’s.] CIVIL CASES. Wm. Sculiy r. John Godwin— Claim £2.—The Clerk of the Court stated that £1 5s had been paid since the issue of the summons, and the remainder was to hare been paid that day. He expected, however, that the state of the rivers prevented it coming to hand.—Judgment was given by default. A Firth v. J. H. Dean, junr.—The summons in this case bad been taken out at Waipawa, North Island, and defendant’s evidence was taken for transmission to the Court there as follows:—I am defendant in this action. Ido not acknowledge the debt. Plaintiff summoned me for hire of horses. I paid him for the hire of the horses and got receipts. One of the horses got hnrt. I think the bill is for damage to that horse, which I do not acknowledge. I (did not keep the receipts after six years had passed over. The receipts would represent the full of the claim. I received no documents or claim for the amount until I received the summons. To the Bench: I paid £ls by cheque, the balance by contra, for which I received receipts. The defendant here pleaded the “ Statute of limitations.” This being all the business the Court rose.
