RESIDENT MAGISTRATE’S COURT.

Temuka—Monday, March 10, 1884. [Before S. D. Barker Esq.] CIVIL CASES. Charles Storey v. A. W. Surridge— Claim £B, value of a horse. Mr Aspin all appeared for the plaintiff and Mr White for defendant. In this case the plaintiff and defendant agreed to,submit to Mr Barker’s decision otherwise he would not have had jurisdiction it not being competent for one Justice of the Peace to adjudicate in the case. The plaintiff stated that he let a horse on hire to defendant at 10a per week. The defendant allowed the horse to fall and cut his knees, and the horse was therefore rendered useless. The plaintiff then declined to take the horse back and claimed £8 as the piice of it from defendant, who agreed to pay the amount. The horse was afterwards offered for sale in Mr Gray’s Yard by defendant. The defendant stated that the horse fell down twice through no fault of his ; that he only offered to pay for the horse on condition that Mr White, of Milford bought it. After hearing Mr White for the defence His Worship decided that defendant had agreed to pay for the horse and was liable. Judgment was given for the amount claimed and costs, including solicitor’s fee.

Several cases were adjourned and the Court then rose.
