[Before J. Beswick, Esq., R.M., and D. , Inwood, Esq., J.P.] CIVIL, CASES. W. Essery v Ellen Break well—Claim £l9s. The defendant admitted the claim, but stated that the debt had been incurred before her husband left her, and that he was liable.

The plaintiff stated that he always did business.with-defendant, that it was Mrs Breakwell who took the goods away, that she promised to pay for them, and that he had taken a part of the original debt out in willow twigs, and that these died. The defendant urged that her husband waß liable, but admitted having piven the plaintiff some willows in payment of the account.

The Court decided that she acknowledged the debt by paying a portion of it, and judgment was given for the amount claimed and costs. J. Brown v. D. Mackay—Claim £32 14a. Judgment by default for the amount claimed and costs. G. Levens v. Prendiville Claim £2 17s. v This account was due for paddocking and attending to a sick horse. The defendant had paid £2 for it, and considered that enough. It. appeared that when the £2 paid ; tjie. defendant’s partner took the horse away before it was well enough. He had to bring the

horse back again, and leave it in charge of the plaintiff for five weeks, and the sura sued for was for this time. Judgment was given for the amount claimed and costs. LUNACY FROM DRINK. Robert Fenton, charged as above, was remanded for a week. The Court then rose.
