RESIDENT MAGISTRATE'S COURT.
Temuka—Monday, Jan. 15, 1882. (Before I. N. Watt, Esq., R.M.) CIVIL CASES. Henry Blissettv. J. Kellaud—Claim £3 19s8d. Mr Aspinall appeared for the defendant. There was no appearance of the pLivif w\ the case was struck out with costs. biegert and Fauvel y. D. Heffernan——Claim £7. Mr Aspinall appeared for defendant, and pleaded that the debt had been satisfied. Julius Siegert said that defendant and Michael O'Connor came into his office. At the request of the defendant M, O'Connor gave witness an order on the femuka Road Board for the amount. The order had not been paid. Francis Henry Rowe, book-keeper to Siegert and Fauvel, heard Mr Siegert tell defendant that if the order was not paid he would hold defendant responsible. To Mr Aspinall : Heffernan did not say that he would not be responsible for. the amount if the order was not paid. Denis Heffernan said the plaintiffs accepted M. O'Connor's order in payment of the amount. He had received no notice of the order bding dishonored. His Worship said defendants should sue Michael O'Connor. The case was dismissed with costs £1 18s.
