Before F. Guinness, Esq. , JR. M. Wednesday, NoyC 6. The Court opened shortly after 10 a.m. DRUNK AND DISORDERLY. Robert Wei by was fined 5s for this offence. CIVIL CASES. Wilson and Sons v Spillane. Judgment summons. Defendant ordered to pay 10s per week, in terms of original order, or be imprisoned for 14 days. Craig and Robinson v Macpherson— Claim £8 lls. Judgment for mount claimed and costs 12s. Hay v Leach—Claim £52. Instalments paid on a house said to have been purchased by the plaintiff from defendant, and value of material used by the plaintiff in additions made to same and work and labor done. Mr White for plaintiff and Mr Johnstone for defendant. It appeared from the evidence that the time for the completion of the purchase of the said house had expired ; but it was also shown that an extension of time was allowed. The defwrtdant admitted haring destroyed the original agreement. The defendant endeavored to show that the time of the agreement had expired, and that the plaintiff was only in the occupation of the houw> as atenant, and was taking the amount originally paid as instalments on house in rent. It was also shown that the defendant had since sold the house and land, and that the house had been burned down. His Worship considered the weight of evidence to be in favor of the plaintiff, and gave judgment accordingly for £4O 2s and costs (£5 3s) —in all, £45. The Court then adjourned for lunch. W, Johnson r R. Donach, claim £4, 9a 4d, for professional service. Judgment for amount claimed and costs. Jno. Yance r J. Moore, claim £34 3s 3d. for wages. Mr Hamersley for plaintiff, Mr White for defendant. Judgment for £26 8s 3d and costs 345. F. E,. Oldfield v Greenaway, claim £25, damages to threshing machine. Mr White for plaintiff and Mr Hamersley for defendant. Judgment for full and costs.
