BROKE PROBATION
YOUTH BEPORE COURT "He seems incapable of understanding his responsibility under pr'obation and 1 don't. think he is a fit case for probation," said Senior-Sergeant C. M. Anniss in the New Plymouth Police Court yesterday when Donald Clive Rugg was charged with a breach of his probationary license in that he had failed to report to a probation officer since June 20. Rugg was before the court last week, when he was remanded until yesterday to permit of inquiries being made into his case. When charged yesterday before Mr. W. H. Woodward, S.M., he pleaded guilty. Senior-Sergeant Anniss said Rugg was arrested in April last at Dunedin for the theft at Petone of £1 10s. He was dealt with at Dunedin, where he was placed on probation on April 10 and ordered to make restitution of the amount of the stolen money, of which he had paid back £1. He had previously been committed to a mental institution, from which he had escaped and having had his freedom for more than three months could not, even if It were possible, be sent back there without examination and recommittal. The . senior-sergeant suggested, in view of Rugg's mental condition, that he should be remanded for observatlon purposes. Mr. T. Stocker, probation officer, said he agreed with what the senior-sergeant had said and with his suggestion. The Magistrate, after some questioning of Rugg, who said he understood what was meant by a breach of his probation, ordered him to be remanded in custody for a week for medical observation.
