MOTION IN BANKRUPTCY. CLAIM BY OFFICIAL ASSIGNEE. A motion for a declaration that certain property on a farm at Nolantown, Hawera, should be passed to the DeputyOfficial Assignee acting in the bankrupt estate of Edgar Joseph Harrison occupied a considerable part of the Supreme Court at New Plymouth yesterday afternoon. It was opposed by the Pease trustees, and at the conclusion of the evidence further hearing was adjourned till 9.15 this morning. Exercising their rights under a mortgage, the Pease trustees, in October, 1925, authorised the sale at auction of certain stock and chattels on a farm at Nolantown. In order to protect their interest in the farm the trustees bought them in and Harrison was engaged at a fixed sum per month to look after them on the Nolantown farm. On April 13, 1926, Harrison was made bankrupt with debts to unsecured creditors totalling £5970 14s. He declared his only asset was furniture valued at £25. The De-puty-Official Assignee claimed to be entitled to stock on the farm and certain shares in a dairy company. The parties had agreed upon a statement of. fact regarding the shares, but the Pease trustees contended they were entitled to the stock and chattels. OTHER BUSINESS. An adjournment till the February session was granted in the case of Newton King, Ltd., versus Richard H. Susans, a claim for £424 Os 5d money paid pursuant to a guarantee. An amendment to the statement of defence included two new allegations, and counsel for the defence said he had not had sufficient time in which to prepare replies. A settlement was announced in the application of Gordon F. Harkness versus Theo. E. Bridger with reference to a dissolution of partnership, payment of accounts and other matters. The claim of Alice Riddiford and others against Brian C. Lysaght for £1025 damages for alleged breaches of covenants would not be coming on during the present session, it was stated. BUSINESS FOR TO DAY. Argument will be heard at 9.15 this morning on the motion to declare certain property passed to the deputyOfficial Assignee, at Hawera, in respect to the bankruptcy of E. J. Harrison. His Honour intimated yesterday that he could devote perhaps 1% hours to this, and if it wae then still unfinished further consideration would have to be adjourned. Wellington counsel have been retained. it is understood, in the motion to declare certain documents void in regard to the bankruptcy of William Kerr, at Stratford. The deputy-Offieial Assignee, at New Plymooth, is proceeding against the Union Bank of Australia over an assignment by Kerr of his interest in certain timber rights on the West Coast of the South Island. Tentative fixtures have been made by His Honour for the hearing of compensation claims at Eltham on Monday
