PILLAGED CARGO
DAMAGES CLAIM SUCCEEDS. By Telegraph. —Prcaa Association. Dunedin, Dec. 2. In a reserved judgment in the case of Bing, Harris and Co. v. Dalgety and Co., a claim for damages of £54 for goods not delivered by the steamer Tainui, Mr. Bartholomew, S.M., held that the goods were pillaged before landing. On the point raised by the defence that liability was limited by the bill of lading to claims made within three days, he hetd that ©ueh a proviso would leesen the liability imposed by statute, and was accordingly null and void. Judgment was given for plaintiffs for the amount claimed.
