NO ROOF ON HOUSE
REMOVAL BY A LANDLORD.
Whangarei, Nov. 11.
The removal of the roof of a house by a landlord in an effort to evict the tenant was revealed in a case heard in the Magistrate’s Court before Mr. F. H. Levien, S.M. A. O. Love, the tenant, claimed £175 10s damages from Murdoch McDonald as actual damage done to furniture through defendant, plaintiff’s landlord, assisted by relatives, removing the roof of the house which plaintiff occupied. In view of the existence of a lease general damages for trespass were also claimed. The evidence showed that while the roof was being, removed, Love was absent and Mrs. Love was in charge of the home. A constable was present to see that good order was maintained.
Evidence was given by Love that McDonald had previously threatened to remove the roof to force Love out of the house, but Love had regarded the threat as a joke. He alleged that the men who did the work were not sober at the time.
The defence was that notice to quit bad been given, and the subsequent proceedings were regarded as a legal right, and the removal of the roof was carried out in a careful manner. It was contended that all damage done was incidental to the removal.
The magistrate reserved his decision.
