MOTIONS OVER -'RULED. Received Dec. 23, 5.5 p.m. New York, Dec. 22. At Marion, the Judge overruled eighteen of twenty motions submitted by attorneys for live miners on trial in the Herrin massacre cape to throw out the testimony introduced by the State. Two motions were upheld. They asked that testimony introduced by the prosecution’s witnesses be limited to the specific five defendants, and not be held ns evidence against the others. Aus.-N.Z. Cable Assn. Received Dec. 24, 5 p.m. New York, Dec. 23. At Marion, the Herrin trial was adjourned till January. Two of the jury were kept in the custody of the bailiff. The defence announced they will have nearly four hundred witnesses.
