The King’s Uench Division, with the Lord Chief Justice (Lord Hewart), Sir Charles Darling and Sir Arthur Salter on the bench, dismissed Bywaters’ appeal, which was based on the grounds of Justice Sir Montagu Shearman’s refusal to take the two trials separately, the inadmissability of the letters, the mifidirection of the jury and that the verdict was against the weight of the evidence. By waters heard the result unmoved.
