TEN-THOUSAND COLT.
DEVELOPS SERIOUS INJURY. CLAIM FOR DAMAGES. By Telegraph.—Press Assn.—Copyright. Received Dec. 20, 8.5 p.m. London, Dec. 19. Mr. James White is suing Lady Sykea to recover damages over the eale by the latter of the Tetrarch colt Noblesse Oblige, for which £lO,OOO was paid. The colt subsequently developed a dropped hip. Plaintiff maintains the defect should have been mentioned 'by the auctioneer, while defendant relies on the condition of eale, by which the horse should be returned if anything is wrong in seven days. Donaghue, the jockey, gave evidence that he noticed the defect when riding him. A veterinary surgeon’s evidence showed that the colt had a broken hip bone. Lattigan, the trainer, who bought the colt, first noticed the defect soon after the sale. He did not inform the owner, -hoping it would recover. Aus.N.Z. Cable Association.
