DEALINGS IN COAL.
BREACH OF TRUSTS ACT. SOUTHERN FIRMS FINED. By Telegraph.—Press Association. Dunedin, Last Night. In a previously heard action brought against a number of coal concerns for a penalty of £5OO each for an alleged breach of the Commercial 'Trusts Act, Mr. Justice Hosking’s judgment was delivered this morning. His Honor found that the Kaitangata Company and the Shag Point Coal Company had committed a breach of the Commercial Trusts Act in agreeing to give the concession described to members of the Oamaru Coal Merchants’ Association and in refusing to supply to Brown, because he was not a member of the Association. Judgment waa entered against both companies for £lO5 and costs. For aiding and abetting the Kaitangata Company the following defendants were fined £5 each: —Vernon Marshall, Amies Cayford Boe, Wilson Hall, and the Westport Company. For conspiring with the Kaitangafa Company, Vernon Marshall, Amies Cayford Bee, Wilson Hall, and the Westport Coal Company were further fined £lO and the New Zealand (Express Company waa fined £5 and costs.
