NEW PLYMOUTH SITTING, CIVIL CASES. The New Plymouth Magistrate’s Court sat yesterday morning, Mr. A. M. Mowlem, S.M.. presiding. Judgment for plaintiff by default was given in the following undefended cases: Newton King. Ltd. v. James Northcott, £5 4s 5d (costs £1 13s od); D. L. Reader v. Norman F. Meads, £3 7s (costs £1 10s 6d); D.O.A. in the estate of C. E. Carlson v. S. A. Campbell. £7 10; (costs £1 17s 6d) ; P. B. Fitzherbert v. Te Ahu Tukuwhakaiho, £22 10s (costs £3 Ils); Henry J. Lowe v. Cranfurd P. Tullock, £155 12s 2d (costs £8 13s 6d): W. C. Weston v. W. G. Taylor, £3 (costs £1 3s 6d) ; Robert Whale v. J. Archibald. £1 16s 6d (costs 8s): same v. D. Crozier, £1 9s (costs 8s). same v. F. V. Burkett, £2 19s (costs £1 3s 6d I : P. B. Fitzherbert v. Tawhanga Eruera, £3B (costs £3 17s Ode Bent and Turnbull v. Philip Eva, £1 9s lOd (costs 8s); Geo. T. Geden v. . R. Arthur, £5 12s (costs £1 10s fid). BY-LAW BREACHES. Norman Wells, on the information of the police, was fined 10s (costs 7s) for using a motor-cycle without having two number plates attached. J. Martin, on a charge of driving a motor-car along Devon Street at a greater speed than twelve miles per hour, was fined £2 (costs 7s), and for driving a motor-car whilst under the influence of liquor, was fined £3 (costs 7s). On two other charges, arising out of the same circumstances, Martin was convicted and discharged. Thomas A. Berridge. for driving a hprse and dray across a water channel in Cutfield Road, was fined 5s (costs 7s). William Marshall and Daniel Le C. Morgan, who were charged with leaving their motor-cars standing in Fillis and Liardet Streets respectively for a longer period than ten minutes, were each fined 30s (costs 7s). The offences, the inspector stated, were committed on,the occasion of a football match at Pukekura Park on July 29. FINED FOR ASSAULT. Thomas John George Taylor, a .storeman on the Kaikoura. was fined £lO for assaulting J. L. Hunter, the fifth refrigerating engineer on the same vessel. It appears defendant, whilst under the influence of liquor last Saturday night, became very violent on returning to the ship, and struck Hunter on the face with his fist. John Fitzgerald, an ex-Naval man with considerable war service, was fined £4 (costs 16s) for assaulting George Yuka by striking him in th? face vfith hi; fist, fourteen days being allowed in which to pay, in default twenty-one days' imprisonment. Mr. Bennett (who appeared for defendant) said that Fitzgerald was very hard of hearing owing to war iniuries sustained on Gallipoli. On go ; n<r into Yuka’s greengrocery shop he asked Yuka what an emblem he hart on Ills wateh-chain was. and mistook Yuka’s reply for an insulting remark. ALLEGED FRAUD. A man. until recently employed by the New Plymouth Borough Council as a meter reader and collector, appeared on two charsres. the first being that on or about, July 29 last he knowingly furnished a false return of moneys collected by him >n a receipt-book entrusted to Irs care by making out receipts ahead, and paid to the cashier money so received on a date later than that on which it should have been paid. The second charge* alleged that on dates between August 3 and August R last he collected <sums of mouev totalling £lO 6s 9d on terms requiring him to account for or pav same to the New Plymouth Borough Council and fraudulently omitted to account for or pav same. On the application of Detective-Ser-geant Cooney (who conducted the case for the police) the accused was remanded till to-day. Accused was granted bail in one surety of £2OO self and two sureties of £lOO each or one of £2OO. The magistrate ordered the suppression of accused’s name.

OTHER CASES. C. H. Sorenson was convicted and ordered to pay costs (14s) for unlawfully carrying a pistol beyond the limits of his dwelling house. A first offending inebriate was convicted and discharged. The inspector of scaffolding laid (in information against James Peterson for erecting scaffolding exceeding 10 feet in height from the ground without having notified the inspector. Defendant, who did not appear, was fined £3 (costs 7s).
