A BANKRUPT DRAPER.

TRANSFER OF PROCEEDINGS. THE CASE OF A. E. WAUGH. An adjourned meeting of creditors in the bankrupt estate of A. E. Waugh v draper, Kaponga, was held yesterday at the office of the D.O.A. (Mr. J. S. 8. Medley), New Plymouth. The D.O.A. reported that he had visited Kaponga on Monday, and found that during the period August lfi-26 the cash takings from stock sold amounted to £134 13s lid, whilst outstanding accounts collected totalled £5l 17s 2d, leaving a balance at the bank of £326 13s Bd.

Regarding tie motion moved at the former meeting that the bankruptcy proceedings should be transferred to Auckland, Mr. Medley said he was still .of the same opinion, that according to the Act this could not be done, but the Official Assignee at Auckland had wired urging him to accept the resolution, which he would do. but, at the same time, he did not feel called upon to take any responsibility in the matter.

Mr. Cook (representing Sargood, Son and Ewen and other creditors) then moved that the bankruptcy proceedings be transferred to Auckland to meet the convenience of' creditors, Mr. McQuade (Macky, Logan, Caldwell, Ltd.) seconding.

Mr. Freeman, on behalf of two Hawera creditors and the bankrupt, opposed the motion, contending that the provisions of the Bankruptcy Act did not provide for the transfer of proceedings after the resolution had been dealt with, and the motion was therefore a waste of time.

Mr. Smith (Archibald Clark and Sons, Ltd.), who supported the motion, contended that Mr. Freeman’s submissions were mere bluff. What jurisdiction had he in the matter if the bulk of the creditors desired to transfer the proceedings ? The. motion was carried. Mr. Freeman asking to have his objections recorded against -the resolution. A further meeting will be held at New Plymouth on September 13 in order to confirm the resolution. *
