MAGISTRATE’S DECISION REVERSED. Christchurch, July 24. In the Supreme Court, Mr. Justice Adams allowed an appeal by Mrs. Dunshea, maternity nurse, against a decision by Mr. M'Cartjhy, S.M., in a case in which F. D. Kesteven, moneylender, sued her for the sum of £155 on three promissory notes which an agent named Black had induced her to sign. When the case was heard in the Magistrate’s Court it was shown that Black sold a section belonging to Mrs. Dunshea. He paid the purchase-money in inc stalments, and on receiving each instalment she signed a form, which Black alleged was a receipt, but it was a promissory note. The promissory notes had been pasesd on by Black to Kesteven for valuable consideration. The Magistrate held that Black procured Mrs. Dunshea’s signature fraudulently, but that Kesteven was a holder in due course of the notes, and gave judgment for the sum claimed by Kesteven.
