MAGISTRATE’S COURT. YESTERDAY’S SITTING. (From Our Own Correspondent.) March 6. A sitting of the Magistrate’s Court was held to-day, Mr. A. M. Mowlem, S.M., presiding. Judgment by default was given in the following cases: Wilson’s Motor Supplies v. F. C. Rodger, £25 9s Id, costs £4 2s; G. W. Peebles v. A. Biggar, 10s, costs 16s; P. W. Allen v. Charles White, £l, costs 13s; F. R. Pepperell v. Patrick J. Power, £5 14s 6d, costs £1 10s 6d; I. J. Bridger v. N.Z. Motor Wrecking Co., Ltd., £2O, costs £2 14s; Wilson’s Motor Supplies, Ltd, v. Francis Lind, £46 Is, costs £4 Is 6d. On a judgment summons C. F. Harrison was ordered to pay H. C. Stanners £26 7s forthwith, the warrant to be suspended if within one month debtor pays £lO, and the balance within two months. CLAIM FOR DAMAGES. An alleged collision between a butcher’s cart, owned by E. A. Cuff and driven by F. Anderson, and a motor car owned by John Swinson, formed the basis of an action for damages, in which Swinson claimed £73 7s 7d from Cuff, plaintiff alleging that damage had been sustained by his car to that amount. Mr. A. A. Stewart appeared for the defendant Cuff, and Mr. Taylor was for plaintiff. Mr. Taylor said that on the morning of the accident Anderson fourid the cart usually used on the delivery round was out of order. He approached his employer for a breeching for another cart, but found it necessary to improvise a breeching. On the delivery the improvised breeching gave way and the horse bolted, damaging the cart and throwing the driver out. Returning to the stables without a driver, the horse brought the cart into collision with plaintiff’s car, which was standing in the street, causing the damage sued for. Evidence was given on these lines. Albert F. Cuff, the defendant, said he had not replied to plaintiff’s demands for expenses because he had previously told plaintiff that he could not afford to pay for the damage. Mr. Stewart, for the defence, submitted that there was no evidence or proof of a collision between Cuff’s cart and the car, and such proof was essential to the success of the action. Mr. Stewart submitted that there was no negligence on the part of the driver. If there were negligence it was not the cause of the accident. The boy having fallen out of the cart was the effective cause. The magistrate reserved his decision until next court day in Eltham—March 20. THE LICENSING COMMITTEE. The quarterly meeting of the Egmont Licensing Committee was held at the Elthain Courthouse to-day, Mr. A. M. Mowlem, S.M. (chairman), presiding.
An application by P. J. Purcell for trans- ' fer of the license of the Club Hotel, Opunake, to J. H. Whitham was granted. An application was entered by J. B. Dunn for a license to conduct two booths at the Opunake Racecourse on March 17, between the hours of 11 a.m. and 5.30 p.m. The nolice objected to the hours, suggesting that the booths should be closed immediately the »Jast race started. Some objection was also lodged as to the conditions obtaining at the booths. A license was granted, subject to police reports, between the hours of 11 a.m. and 5.30 p.m. The chairman expressed dissatisfaction with the conditions of the booths. He had been informed that the accommodation was insufficient. If improvements were not carried out—and in view of amendments to the Public Health Act —he would absolutely refuse to l ' grant a license. FIRE BRIGADE COMPETITIONS. The Eltham Fire Brigade held its local competitions at Taumata Park on Saturday, when the Gilberd Memorial Shield, Cresswell Cup and a trophy presented bv Fireman A. M. Burrows were competed for.
