ELTHAM CASE.

A RE-TRIAt CONCLUDED. COULTER BROTHERS GUILTY. , The brothers, Bernard and Arthur Coulter, charged with breaking and entering at Eltham in November last, were again before the Supreme Court at New Plymouth yesterday, when the re-trial of the case was proceeded with. At the first hearing last week the jury were not able to agree. The elder brother, Bernard, was also indicted on charges of assaulting Adam Rae, a nightwatchman. and Bessie B. Scott, who accompanied Rae on the night when the latter is said to have discovered accused Bernard Coulter on the premises of the Bon Marche drapery shop. Eltham. He was also charged with having skeleton keys in his possession. Other witnesses for the Crown were A. E. Waugh, proprietor of the Bon Marche, Mrs.. B. Scott, who accompanied the nightwatchman, Constable Townsend. and H. F. Vossele. engineer. Evidence for the defence was given by V. Carlson. R. Scown. Chas. Pennington, Mrs. Beatrice Coulter (mother of the boys), and Enid Coulter (sister of the accused). The jury retired at 4.15 p.m. and returned at 7.55 with a verdict of guilty against both accused, and also against Bernard Coulter on the separate counts. They added to their verdict a strong recommendation for mercy. His Honor deferred sentence.
