Andrew Grant Hart was charged with, on December 12, using obscene language in Broadway. Defendant did not appear, and the magistrate remarked that he should be in court, as on conviction the court had power to inflict sentence up to one year’s imprisonment. Sergeant Dale said that on December 12 accused went to the taxi stand on the corner of Fenton Street and Broadway, in a more or less drunken state, and had accosted Mr. J. Fryday, one of the taxi drivers, and had called him a number of vile names. Evidence of this was given by John Fryday and others. The magistrate said that in his opinion there was no question whatever that a man who such as that complained of in a public place could only be properly punished by a term of imprisonment. In view, however, of the fact that accused is a married man with four children dependent upon him, who would suffer by his imprisonment, he would be fined £lO and £1 10s costs. Accused had the benefit of his position. If a woman or child had heard the language, or been within hearing, he would have had no option but to inflict imprisonment. CIVIL CASES.
