MILK SUPPLY CLAIM. -- I By Telegraph.—Press Association. Wellington, Sept. 27. An important civil action regarding the supply of milk to the City Corporation by the Wellington Dairy Farmers’ Co-opera-tive Association is being heard in the Supreme Court to-day. The association is claiming sums totalling £5038 8s Bd, upon three causes of action: That the corporation had paid lower rates than agreed upon; that one of the scales used in weighing the milk at the city depot was incorrect, inasmuch as 42 gallons were recorded as 41; and that the corporation had wrongly made a charge of £5O 14s for the use of cans employed in supplying milk. The third claim is not actively disputed, and the sum claimed with costs has been paid into court without prejudice. CHARGE OF PROFITEERING. Auckland, Sept. 27. In the Magistrate's Court, before Mr. Poynton, S.M., Tonson, Garlick, Ltd,, were charged, on the information of the Board of Trade’s solicitor, with selling to F. J. Williams, of Waipare Bay, near Gisborne, 32 mattress cases at £B2 10s, which price was alleged to be unreasonably high.
The defence was that the mattresses being required for shearers’ beds, were made of extremely strong quality; that when the protest was made by Williams he was given a reduction of 10 per cent, as on a wholesale order; that after the action had been instituted it was discovered that a gross clerical error had been made by a young lady in the factory. Williams, examined by Mr. McVeagh, said he was not aware that the defendant company had sent a cheque for £2B 14s 6d to him, care of the Board of Trade. Further hearing was adjourned till October 14.
