ARBITRATION COURT.
COMPENSATION CLAIM. By Telegraph —Press Association. Gisborne, August 8. In the Arbitraton Court judgment was for defendant in the claim for £5009 compensation made by Harry Dujany against the Gisborne Sheep-farmers’ Company. The case presented unusual features. Plaintiff was engaged in general work and was sent to the blacksmith’s shop as striker. Whilst using a hammer he felt a pain in his chest, accompanies] by dizziness, and since then he had been unable to do anything but light work. The medical evidence was conflicting. There was general agreement that plaintiff’s heart was affected, but a conflict as to w 7 hether the condition was due lo a sudden strain. The court discussed (he medical testimony with Dr. Fitchett (Dunedin), and slated that the strong probability is that plaintiff’s heart was in an unhealthy condition previously, the presumption being that hummer found the trouble out, but did not cause it.
