ELTHAM HOTEL CASE.

Wellington, July 15. The hearing of the appeal in the case of Gant v. Fanning was concluded by the Court of Appeal this morning.
Mr. Parry for the respondent, Fanning, contended that, since Fanning had found a willing purchaser, he was entitled to commission. The contract obtained by the agent was, he said, of such a nature that the specific performance of it could have been obtained by either party. On the question as to whether the authority to sell was insufficient he submitted that since the point had not previously been raised it was open to appellant to take that point. After Mr. Kennedy had replied the souxt reserved its decision.
