Broadway, Stratford: Orders for papers may also be left with. them. CLAIM FOR REPAIRS A MOTOR CASE. June 18. At the Stratford Magistrate’s Court on Friday there was a lengthy hearing of a claim for repairs to a motor car, the hearing lasting till late in the evening. Charles Hall (Mr. Cotynan) claimed from William Thompson (Mr. Lawrence) the sum of £2l 12s, being the cost of repairs to a car. Thompson counter-claimed for £8 for sundry items. Charles Hall gave evidence to the effect that he was motor engineer previous to taking up farming. At the request of Thompson he inspected the car in question at Inglewood. Witness advised Thompson to buy the car. Thompson decided to buy the car, but when they went to start it up the battery was found to have run out. The car was taken to Hall’s place for repairs at Thompson’s request. Witness and an assistant went to Hawera and purchased spare parts which Thompson authorised. Evidence was given by several witnesses as to the value of the car and these agreed that it was in a bad state of repair and apparently not worth more than £5O, the price paid for it by Thompson. .H. Kleeman, motor engineer, Stratford, said that for the work said to have been done a fair charge would have been £25. Another engineer put thei cost at £36. For the defence, Mr. Lawrence said that Thompson understood the work was being done voluntarily by Hall and that no charge was to be made. Defendant,' in evidence, said that he advised Thompson to buy the car and they would put it in order between them. He spent at least four days in taking the car to pieces. Included in Thompson’s counter-claim were items for towing Hall’s car at 5s per mile, and for milking Hall’s cows while he was away. The Magistrate said the evidence did not disclose any contract to pay. If it were a matter of law plaintiff must be non-suited, but the case was one in which the equity and good conscience clause should operate. If plaintiff did work of value, even if there was no agreement to pay for it, plaintiff should be paid, unless the services rendered had been offset by other services._y He assumed that what was due 1 to Hall amounted to £l5 and allowing for the i offset of £5 Hs 6d, he gave judgment for plaintiff for £9 8s 6d. No costs were allowed. GENERAL. The Stratford School Committee, in view of the social in the Town Hall on Thursday next, held a conference with the teaching staff on Friday, and made arrangements for the function. An appeal is now made to the parents and scholars in connection with the supper, which may be depended upon to bp satisfactory. * Any assistance that may be forthcoming will be greatly appreciated bv the committee. A first-class concert programme will be presented for an hour before the dance, for which Fox’s orchestra will supply the music. It may be stated that the committee has to face a big expenditure in connection with the erection of a shed for the heating system in the. cocoa scheme and all the public support possible on Thursday next will be much appreciated in the interests of, the children.
