MAGISTRATE’S COURT.

NEW PLYMOUTH SITTING.

A sitting of the New Plymouth Magistrate’s Court was held yesterday, before Mr. T. A. B. Bailey, S.M., when the following civil cases were dealt with:—

Judgment by default were given in the following cases: —L. S. Hart (Mr. T. Ball, for Messrs. Weston and Billing), v. Mohorangi, £6 (costs £2 5s 6d); W. D. Graham (Mr. Ball) v. E. Clark, £lO 2s Id (costs £3 2s 6d); New Plymouth High Schools Board (Mr A. A. Bennett) v. H. M. Lee, £35 17s lOd; C t W. Revell (Mr. Bennett) v. Henare Ramira, £73 14s (costs £5 Ils 6d); Fitzherbert and Fitzherbert (Mr. L. Etherington) v. Pare Kawhia, £l9 3s lOd (costs 10s); same v. David Mitchell, £24 15s lOd (costs £3 18s 6d); same v. Waiata Remana, £23 8s 2d (costs £3 10s); E. P. Webster (Mr. R. H. Quilliam) v. A. L. Wolfe £lO 5s 6d (costs £3 Is); same v. H. G. Weston, £3O 16s 6d (costs £4 Is 6d)j F. Baker (Mr. C. R. Stead) v. W. H. Garmonsway, £146 13s lOd (costs £7 5s 6d); Jellyman (Mr. Croker) v. Darling, £l4 17s 6d (costs £1 ss); F. S. Butler (Mr. A. A. Bennett) v. R. Williams, £1 17s 3d (costs 8s); Snelling and Andrews (Mr. Anderson) v. George Blane, £6 (costs £1 10s 6d).

In the case, Helen Hughes v. John Charles Smith, defendant was ordered to pay the amount of judgment and costs ( £6 8s 6d ( in all) forthwith, in default six days’’’ imprisonment, the order to be suspended so long as defendant paid £1 per week off the debt.

In the case of Wm. P. Nicoll and Co. v.’ Geo. Bennett, farmer, of Korito, the Magistrate declined to make an order, as it appeared that defendant had no hope of being able to pay.

GOBLE v. nft/L.

The Magistrate delivered his reserved decision in the case in which -Henry Goble claimed £52 from N. W. Hill for breach of warranty on the sale of certain cows. After tracing the case at length the Magistrate gave judgment for defendant with costs ( £4 13s 6d).
