CLAIM FOR IuLL REFUND.
AN INTERESTING POINT.
By Telegraph.—Press Association. Last Night. The right of an intending passenger to the refund of the whole amount of his deposit steamer money on cancelling his booking for a berth was the subject of an action in the Magistrate’s Court to-day, when Robert Deb Hovell proceeded against Levin and Co., agents for the Shaw Savill Line.
The plaintiff, who paid £l7 10s as a deposit on reserving a berth on fche Arawa in December, alleged that there was a distinct understanding that he should have the right to abandon the reservation of the berth without incurring liability . On cancellation plaintiff received £lO 10s. and the action was to recover the balance.
Evidence given for the company stated that the practice was that an intending passenger on cancellation of his berth forfeited ten per cent, of the twentyfive per cent, asked as a deposit when the passage was booked. It was admitted that in this case three and a half months’ notice of cancellation had been given. Judgment was reserved.
