IMPORTANT TO DAIRY FARMERS.
A RESTRAINT OF TRADE. A considered judgment delivered by Mr. F. K. Hunt, S.M., in respect to the case of the Te Horo Co-operative Dairy Company, Ltd., against Sawyer and Pullman, two suppliers of milk, is of considerable importance, and is likely to have a far-reaching effect if the judgment is upheld by the Supreme Court on the appeal, which is to be made to that court. The case was heard at Qtaki. I The plaintiff company sought to recover from the defendants sums of £lO and £l2 for failure to supply milk in the terms ;,f the Articles of Association. These made it obligatory on members to -supply the whole of the milk they produced, except a reasonable quantity for home cons.imption or rearing young stock. A penalty of £1 a cow was provided. The defendants, it appeared, had supplied a neighboring factory, which was giving a halfpenny per lb more for butter-fat. The magistrate, in his judgment, held that the Article of Association amounted to a restraint of trade and was not enforceable.
