FARMERS AT COURT.
CLAIM FOR £137. CONCERNING A BILL OF SALE. In the Magistrate’s Court, New Plymouth, yesterday, before Mr. T. A. B. Bailey, S.M., Ed. J. Baker (Mangorei) proceeded, against Wm. Garmonsway (Jvoru) for the recovery of possession of certain chattels, or a sum of £137, being the value of the property and damages sustained through their non-de-livery. Mr. A. A. Bennett appeared for plaintiff, and defendant was represented by Mr. C. H. Croker. The action arose out of the sale of a farm by Garmonsway to Baker, plain- . tiff alleging that he had not received Certain chattel.* which should have been hartded over with the property. These were set out in the statement of claim as follows: Three dairy cows, one buggy, two sets of harness, one disc and harness; total value, £107; loss of milk from cows, £3O. Mr. Bennett said that on March 29 last year the plaintiff entered into a memorandum of agreement purporting to c&rry out the purchase of defendant’s farm. Baker had to take over a liability under a bill of s’ale to the Maoriland Dairy Company, and, counsel contended, hd was certainly entitled to assume that he was to receive all the stock mentioned in the bill of sale. He should have got delivery of 30 dairy cows, but when it came to taking possession only 28 were received. After this Garmonsway, by arrangement, grazed the cows for six weeks, but when he handed them back the herd was one short. Counsel proceeded to deal with other items mentioned in the bill of sale. Evidence for the plaintiff was proceeding when the Court rose**shortly after five o’clock, and the case will be resumed next Monday.
