DIVORCE REFUSED.
BENEFIT OF A DOUBT. AN IMPORTANT CASE. By Telegraph.—Press Assn.—Copyrltht. Auckland, Last Night. The divorce case in which Mary Andrews sought a dissolution of her marriage with Ernest Frank Andrews, was concluded in the Supreme Court today. His Honor said the ca.se was an important one as a serious charge was made against respondent. If there was reasonable doubt, respondent should have the benefit of that doubt. The jury, after a retirement lasting two hours, returned a verdict in favor of respondent. They stated that, in their opinion, there was not sufficient evidence to prove adultery. His Honor said he quite agreed with the verdict. He was sure he would have come to the same decision himself.
An order was made for the payment of the wife's costs by respondent, to an amount to be fixed by the Court if the parties failed to agree.
[Allegations of adultery were made against. Ernest Frank Andrews, secretary of the Auckland Returned Soldiers' Association, by his wife, Mary Andrews, who petitioned for a divorce. The petition stated that the parties were married at the Methodist Church, Avondale, in 1909. It was alleged that on October 7, 1916, and on various other dates between March 1, 191 G. and February, 1918, respondent committed adultery with a certain woman.
