MAGISTRATE'S COURT. (From Our Own Correspondent.) October 20. The fortnightly sitting of the Eltham Magistrate's Court was held to-day, Mr. T. A. B. Bailey, S.M., presiding. Judgment was given for the plaintiff bv default in each of the following cases: —M. Behl (Mr. Gibson) v. R. F. Thomas, £4 12s (id (costs £1 Us fld); C. A. Wilkinson, Ltd. (Mr. Sheat) v. Frank Clement Crookes, £.5 17s l()d (costs £1 lis lid); Cyril L. Wilson (Mr. Sheat) v. John Hunter Graham, ft) 18s Cd (costs £1 10s (id).

On a judgment- summons M. Loveridge, who did not appear, was ordered to pay the Te Mala Vineyards, Ltd. (Mr. A. Stewart) the sum of £,?> 15s fld forthwith, in default six days' imprisonment.

The adjourned case of Edward Antony Laurent. (Mr. T. B. Crump) v. Joseph Kerr (Mr. A. A. Stewart), a elaim for £20(1 damages in respect of alleged wrongful conversion of a bull and loss of efficiency, was continued. Further evidence was given for the plaintiff by Joseph loins farmer, of Oinopa.

At the conclusion of the evidence Mr. Stewart applied for a non-suit on the grounds that there was no evidence that Kerr had wrongfully taken the bull. The Magistrate granted the non-suit, and he said lie could not find that the efficiency of the bull had been-material-ly impaired, and no damages had been proved in regard to conversion or to delay in delivery of.the bull. When the bull was identified the responsibility for removing it was Laurent's, and not Kerr's, and on the facts no damages whatever had been proved. Mr. Crump applied for leave to appeal.

The Magistrate granted the application, and fixed security for the appeal at £2O ss, Kerr being allowed costs amounting to £ls 14s. The case of Kerr v Laurent, a claim for £2OO damages for alleged trespass, was withdrawn, and Laurent was allowed costs amounting to £lO 10s.
