DAMAGE TO SHIP.
FAILURE TO REPORT IT. ACTION TAKEN IN COURT. By Telesrauh.—Press Association. Auckland, Last Night. In the Police Court, Chris Thomsen was charged that, as master of the steamer Kahu, when that ship's hull received material damage in Waihou Bay on March 22, he failed to report Bame to the Marine Department. Captain Fleming stated that the vessel was overhauled at Napier, and was being brought to Auckland for delivery io Munro Bros., who had bought her from Richardson and Cou vVhen the new owners took charge a dent in the i hull was discovered. No doubt the matter was not reported for fear it might affect the sale of the vessel. Had the vessel not been put on the slip, the new master might have been blamed for the damage. The defence was that the side of the vessel was merely scraped by driftwood, causing no material damage, and the matter was not considered worth notice. Mr. Poynton, S.M., said that in view of a civil action for damages being taken, and the fact that the damage did not appear serious, he would not make the penalty a heavy one. Defendant was fined 40s and costs 7s.
