REPAIRS TO MOTOR-CAR.

CLAIM AND COUNTER-CLAIM,

The case of P. V. Burkett, motor car I repairer, of Stratford, against Mrs. Paul j Stachurski, of Fitzroy, for payment of | £6O 17s 6d for repairs to defendant's Overland motor car, was resumed at the Stratford Magistrate's Court yesterday before Mr. T. A. B. Bailey, S.M. Defendant had paid £2O into Court in respect of the claim against her and put in a counter-claim for £IOB, for the use of the car while it was in Burkett's possession, she alleging that be had used it as a taxi cab, instead of repairing it and selling it, as she had instructed him to do. Mr. R. R. Tyrer appeared for the plaintiff, and Mr. C. H. Croker for the defendant. Barbara Stachurski, wife of Paul Siafhurski, Fitzroy, stated that in April, 1910, Burkett came to her place and said he had heard she had a car for sale. She showed him the car, and he asked her how much she wanted for it. She said she would sell it for £l3O, and he said he could easily get that for it, after it had had a little fixing up. Burkett said he would fix the car up for £2O, but some time after he charged her £6o,instead of' £2O, and said the work had coat him that. Witness said she K-ould pay him £2O, and £6O when the ear was sold. The sum of £2O had been paid into Court after the car had been sold. Paul Stachurski, husband of the defendant, gave evidence to tho effect that oh several occasions he had seen Burkett out with the car full of passengers. . James Lock, New Plymouth, stated that he saw the car on hire on the first day of the Stratford Show last year. Anton Wisnewski, farmer, Cardiff, stated that Burkett told him he intended to use the car for hire in order to make up for what it had cost him to repair it. Witness saw Burkett using If for hire on January 2nd. The Magistrate intimated that he would give his decision on next sitting day (Friday, September 10th.)
