A SHAREMILKING CONTRACT.
PARTIES DISAGREE. COURT PROCEEDINGS. Arising out of a sharemilking eontract, .}. Wisnewski and I'. M. O'Shan-1 nossy claimed from F/ J. Greemvay the I sum of £~il IDs Bd. The defendant j counter-claimed for £(>o, for loss sus- i tained through the neglect of plaintiffs ! to perform their obligation? under vari- j oils clauses of the agreement. .Mr. ) Croker appeared for plaintiffs and Mr. Bennett fur the defendant. Mr. Bennett said it wan admitted that the plaintili's were entitled to a credit of £2O for moneys deducted, but he did not concede the point that the moneys were wrongfully withheld. P. IT. O'Shannessy, now living at TaI'ata, said he was a sharemilkor at Punil)o for Mr. Greemvay, commencing in July last. He gave evidence regarding various work claimed for, which was done at the order of Mr. Greemvay, the pay agreed to being Is fid per hour, these being extra jobs, outeide the agreement. The total claim in this connection was £lB 10s. They were given to understand that the rubbers on the milking machine were in good order, but these subsequently were found to be infested and dirty, contaminating the milk, and had to be replaced at a cost of £7 9s 8(1. With regard to the items in the counter-claim ;for loss of cows by death, witness admitted liability for compensation for one at £O. Replying to cross-examination by Mr. Bennett, witness said the rubbers, about which there was some dispute, had recently been taken by him and sold. Evidence was also given by Joseph Wisnewski, the other party to the agreement Frederick J. Croenway, farmer, residing at Barrett Road, said he agreed to pay O'Shnnnessy and Wisnewski Is fid per hour for work in connection with a culvert, but. he thought the time charged . (!)6 hoiy's) was excessive. He denied agreeing to pay them for cutting of willows; what he said was -that if they wanted the willows for firewood they eonld have them for the cutting. The shifting of a fence, which was also charged for, was done without his auth r ority. With a view to arriving at aii amicable settlement, witness had an inspection of the property made by Mr. T. Julian, in company with witness and O'ShannesSv and Wisnewski. Witness was cross-examined at length by Mr. Croker. He denied congratulating O'Shamjessy and Wisnewski on the good job tlicv had madt of the culvert; also as to agreeing about paying for branding cattle and other work. At this stage the Court adjourned till next week.
