In eoßfleetion with the recent ease in which Hugh McLean Urquhart, a youth of fifteen, claimed £IOOO for the loss of u eye caused by an explosion which occurred during an experiment in chemistry in hie classroom, and in which the jury awarded £BOO, counsel for the defendant, the Ashburton High School Board, applied for a non-suit on the grounds that there was no evidence of negligence and that the relation of master and servant did not exist between the board anfi teachers to-day. Mr. Justice Herdman dismissed the motion for a non-suit, and gave judgment for the plaintiff for the sum •warded by the jury, with costs.
