A ease- that occupied the Magistrate yesterday for some time was a claim py Ernest- J. Wilde, of Marton (Mr. R. L. Stanford) against J. H. Robson, of Pohokura (Mr. H- L. Spratt) for £49, made tip as follows: £.lO for work done, £25 for tramway rights and £l4 for timber wrongfully removed. In crossexamination, plaintiff's manager (A. J, Spence) denied the £25 was to be taken in timber. Defendant, who counter-claimed for £3O 14s for damages and loss, said plaintiff wanted a right of way so as to avoid an awkward place. They arrived at an agreement, plaintiff suggesting that it was worth £25 in timber. When defendant asked plaintiff to put in an order for the timber, the latter said he was not going to build till after the war. In giving his decision for a nonsuit as to the £25, the Magistrate remarked that the contract was evidently for £25 worth of timber. Judgment would be given for plaintiff, however, for the remainder, £24 16s. In connection with the counter-claim the action of plaintiff was somewhat high-handed. In an endeavor to assert his rights a man often did things which were wrong. The damage in the present ease was not very serious, and he assessed it at £5, That matter of costs was left to arrangement between the counsel engaged,
