MAGISTRATE'S COURT.

YESTERDAY'S SITTING. (Before Mr. T. A. B. Bailey, S.M.). In the Magistrate's Court yesterday, before Mr. T. A. B, Bailey, S.M., the following cases were dealt with:— Dan LeC. Morgan was fined 10s and costs for leaving a motor car standing in Queen Street at night without having lights on it. Wm. D. Blair, charged with the theft of a postal packet, was, on the application of Sub-Inspector Hutton, further remanded till Thursday next. Mr. S. W. Fitzherbert, who appeared for defendant, asked for bail, which was granted on the same terms as previously fixed. In the case of James Tanner, charged with a breach of the regulations govern, ing whitebait fishing in the Waiwakaiho, which was: adjourned from last week, the Collector of Customs (Mr. R. B. D. Eyre) said there was considerable doubt as to whether the defendant was actually in the County and he was inclined to think he had been in the Borough. Mr. R. H. Quilliam applied for the information to be dismissed, and the Magistrate granted the application. In the case of the Borough Inspector (Mr. R. Dny) v. Scott Colville, who was charged with altering the division of the seats in the Empire Theatre on the occasion of the "Dandies" recent visit here so as to charge more than the advertised prices for certain seats, after hearing the argument of counsel on the question of the reasonableness or otherwise ox ! the by-law, the Magistrate upheld the by-law and convicted defendant and fined him 40s and costs (£1 8s), fixing security for appeal at £l4. Mr. Bailey "remarked that as this was the first case' of the kind brought here the fine was a light one. If any others came before him the fine would be so heavy as to j make the practice not worth while.
