».. _^ Ji>- _ RECENT LITIGATION. In the Supreme Court ,at Wellington on Wednesday, Mr Justice Hosking delivered reserved judgment in an action which was heard some time ago at Auckland, and adjourned to Wellington for argument. The plaintiff in the action waa George William Minter, of for whom Mr A. W. Blair appeared, and the defendant was Percy Arthur Hadley, of Auckland, company manager, who was represented by Mr M. Myers. The plaintiff claimed £IOOO in respect to which a promissory note, due May 19, 1918, had been dishonored. The plaintiff contended that the advance of £IOOO had been made by him on the understanding that defendant utilised the money in connection wftli an oilboring contract, and he further alleged that the defendant never entered into this contract, and that the whole basis •on which the advance had been made had gone. The defendant, in his statement of defence, alleged that he was entitled to retain the money until he had obtained the contract, and that nothing was payable except out of the contract moneys after the contract had been obtained. Defendant also counter-claimed for the sum of £2106 7s 2d, alleged to be due for the balance of purchase money In connection with certain shares in an option, the liability for which had been undertaken by plaintiff. In a very lengthy judgment, which dealt fully with the various transactions between the parties aiid the voluminous correspondence involved, His Honor decided that neither the claim nor counterclaim could succeed, as action had been commenced too soon in both cases. Both claim and counter-claim were accordingly dismissed without prejudice and without costs.
