Wilson, S.M., wherein Alfred William -Osborne, factory manager, claimed £2OO damages from the Meremere Dairy Company for alleged wrong<nl dismissal. The factory closed down at the end of May and plaintiff contimed as manager until June 11th, When he waa called before the directors meeting, and notified that he had been engaged for another season. Pl»«>"» continued as manager during the off wason, but on, July Uth received a Setter from the directors stating that %hey were very dissatisfied with Bib management, and stipulating new terms TOd°conditions, (failing compliance Wherewith the engagement would terminate. Plaintiff did not sign the document, and replied with a spirited fetter on August 14., The chairman of directors, thereupon, wrote to the plaintiff, handing him a cheque for a •month's salary in #eu of notice, also the. amount <rf wages from August 1 to
Plaintiff's counsel said that plaintiff lad I>een unable to secure another fac*to*v engagement this season, and contended that his refusal to sign was not sufficient" around for dismissal. The cross-examination of plaintiff was not Concluded when the court adjourned.
