ORANGE PROFITEERING.
MAGISTRATE STRIKES CASE OUT. Xapier, Dec. 5. At the Xapier Magistrate's Court 011 Tuesday last, ft Chinaman named Yen Kec was fined. £25 for selling oranges at Cd each. At the court this morning the Magistrate (Mr. R. W. Dyer) 'brought up thp case again, and stated that, he had wen perusing the Act, and had come the conclusion that there was nothing in the Act giving him jurisdiction to -leal with such cases. b'enior-Sergeant liales agreed that the Act was very vague and misleading. Mr. Gleeson, who appeared for-the defendant, pointed out that if the case went to the Sw»reme Court the only thing he could'do was to enter a plea of guilty. The Magistrate then struck out the case for want of jurisdiction.
