Timaru, August 2. Mr. Justice Herdman and a jury of twelve were occupied for two full days in a suit for personal injuries sustained by Mary Eandall, tea room waitress, Christc'hurcli, aged 30. She- was on holiday in September, 1010, and was* a passenger for a round trip in the Timaru Herald mail car in the district. The car got out of control in descending ft' steep hill and ran away, was turned into a hank and the axle broke; thg car being upset, and Misss Randall'sustained a fracture of the pelvis, and is still suffering from the effects. She sued tfic Herald Coinpany for £IOOO general and £l3B speial damages. Plaintiff asserted that the car was ill-found and the driver negligent, which defendant denied.
The jury found that the car was not properly equipped and the break gear" defective, and gave a verdict fo.r £438, • with costs as per scale.
