WINE LICENSES.
HAWERA APPEAL CASE, By Telegraph.—Press Association. Wellington, Lant Night. ' The Full Coiirt heard argument in the cases of Crawford v. Nutta.ll, and Challis v. Nuttall. Tiiese are two appeals from the decision of Mr. Haselden, S.M., at Hawera. Appellant Crawford, who trades as Wendel and Co. (Auckland), is the holder of a New Zealand wine license for premises situated at Auckland. Appellant Challis is the agent for Crawford, and took orders in Hawera ,for various quantities of ivine from six bottles to twenty-four gallons. Orders were signed by customers tin Hawera and transmitted to Auckland. Supplies were delivered by carrier. From private customers cash was collected on delivery, and credit was given to "trade" customers. The cases were addressed to the carrier, not to customers.
Appellant Crawford is the holder of a New Zealand wine license, , which authorises the licensee to sell New Zealand wine, cider, and sherry on premises specified in the license in any quantity not exceeding two gallons at any one time to any one person. ' The «ase for the Crown is: (1) That the sale did not take place on licensed premises; (2) that appellants, not being holders of wholesale license, have sold wine in wholesale quantities. Appellants contend: (1) That the. sale took place in Auckland; (2) that no license is required for wholesale trade in New Zealand wine.
